Meghan Markle aka The Duchess of Sussex wrote a personal letter to her father, Thomas Markle, and it was published by the media for the public to read.

As a result, it was held by the High Court that Meghan Markle's privacy was indeed, invaded by the newspaper.


Meghan positively stated that that her win was a representation of doing the right thing despite of the upcoming criticism and fear one may face.

Although the clear fact is that Meghan succeeded in a legal battle against the British media, what most people willingly deny is that she succeeded in a legal battle that members from the royal family would have probably avoided. Considering all the stories that must have circulated in history around the royal family, it is certainly ironic that Meghan 'The American Actress' who had a some-what normal life, is the first to take action and defends herself from the British media. She demonstrates strength and the ability to practice her moral beliefs despite her environment believing otherwise.


Setting my opinion aside...there is still an obvious question that must be answered...Could the ruling in Meghan's case stop the media using leaked documents?


Here we have a major conflict between Article 8 HRA 1998 (right to privacy) and Article 10 (freedom of expression). There is an argument that editors should have the right to express themselves and their opinions through newspapers which is important as we live in a democratic society. Nevertheless it is crucial to point out that regardless of Meghan's role and position in society she should have, at least, some privacy about her life. Or does the right to privacy not apply to her merely because she is a member of the royal family? This proposition is untenable because it suggests that Meghan's human rights are essentially stripped away because she fell in love with a prince...


Conclusively from a realistic point of view, Meghan's relationship with her father serves no legitimate public interest. The aim of the publication was to share a 'exclusive story', keep the public entertained whilst Meghan was still 'trending'. The publication of the letter has no personal impact on the British public instead, it disregards Meghan's feelings by keeping her in the negative light that she was placed in from the beginning of her position as the Duchess.
